Your personal information and how we collect it is something we take very seriously here at Hoppsharing BV. The following policy applies to data and information collected when you use Hoppsharing BV’s network of websites, including www.behoppy.be (including all versions optimized for viewing on a wireless or Tablet device); any email newsletters published or distributed by Hoppsharing BV; any apps published by Hoppsharing BV, including the “Hoppy” app; Activate a Hopp vehicle (“vehicle”) or use other services made available by Hoppsharing BV (“service”) and any other interactive features and communications offered, however accessed and/or used by Hoppsharing BV (“app”), which are operated by us, made available by us, or produced and maintained by us and our related companies (collectively “hoppy” or “we”, “us” or “our”).

We have adopted this privacy policy (“Privacy Policy”) to let you know what types of personal information we collect during your use of this app, why we collect your information, what we use your personal information for, when we may disclose your personal information and how you can manage your personal information.

Please note that the practices described in this Privacy Policy apply to information collected online through our app, through our websites and otherwise by our Customer Service personnel. It does not apply to information you submit to organizations that we may link to or that may link to us or information we may receive about you from other organizations.

By using our app, you accept the practices described in our privacy policy. If you do not agree to the terms of this Privacy Policy, you may not use the app. We reserve the right to change or modify the terms of our Privacy Policy from time to time without notice. What information is collected and stored about me?

We collect two basic types of information from you in conjunction with your use of the app, personal information and non-personal information. Personal information is information you provide to us, as more fully described below, i.e. when you use our services, obtain a subscription, complete a survey, register on the app, upload content, participate in a community or provide your email address.
Personal information is any information that can identify you individually and includes, among other things, your name, e-mail address, telephone number, mailing address, credit card, billing and contact information.
Non-personal information includes information that does not personally identify you, but it may include tracking and usage information about your location, demographics, use of the app and the internet.

Personal information

  • As a general matter, when you browse the app without providing your personal data to us. However, there are a number of circumstances in which you may provide us or our staff, with your personal data. Below is an overview of the most common ways in which we may collect your personal data.
  • Register for an account in the app
  • Use of the account via the app, including renting a vehicle
  • Payment information provided to Hoppy when renting a vehicle
  • Registration for an event sponsored by Hoppy
  • Profile information you provide for your user profile
  • Information about social media you authorize
  • Certain location data, as described below
  • Upload content to the app
  • Apply to work at Hoppy
  • Participation in surveys, contests or sweepstakes
  • Sign up to receive notifications or other information via email, text or instant message from Hoppy Request for Customer Service, support requests or other help
  • App-related communications, e.g. account verification; technical notification
  • Participation in communities, commenting on blog posts and participation in other forums that submit content or other data and information about any part of the app that it allows
  • Any other place on the app where you knowingly leave personal information voluntarily non-personal information

In addition, through the app, we may collect certain information that does not identify you individually. In addition, when you communicate, our servers may automatically maintain an activity log of your use of our app (“non-personal information”).

In general, we collect and store the following categories of non-personal information:

  • Non-identifiable demographic data such as age, gender, and zip code as part of the collection of personal information
  • Device data about your computer, browser, mobile device or other device you use to access the app. This information may include IP address, geolocation data, unique device identifiers, browser type, browser language and other transactional information.
  • Analytics and usage information about your use of the app, including GPS routes and the status of GPS chips.
  • Device information about the hoppy vehicle, including timestamps, battery status.
  • Additional ‘ traffic data ‘ and log files such as time of access, date of access, software crash reports, session identification number, access times and referring app addresses.
  • Other information about your use of the app.

In addition to the personal information we collect, we also gather photographic data through our mobile application. This includes ‘end ride photos’ that riders are required to take and submit upon completing their ride, as well as any photos sent during interactions with our customer support team. These images are essential for verifying ride completion, ensuring the safety and proper use of our vehicles, and assisting in resolving customer support queries. 

Our mobile application requires access to specific functions of your device for optimal service delivery. This includes camera access for scanning the vehicle’s QR code for rental purposes and verifying driving licenses and user identities. Additionally, users may voluntarily add a photo to their user profiles. We assure you that any data accessed under these permissions will only be used in accordance with this Privacy Policy.

The app utilizes camera permissions for scanning QR codes on e-cargo bikes and taking end-ride photos. These photos are stored on our servers to analyze parking behavior and enhance service quality.

We request users to capture a photographic image of the vehicle’s parking spot at the end of each ride. This image is retained to confirm that the vehicle has been parked safely and appropriately.

Collection of your source IP address/location information

We collect and store location data about you that is associated with your account in the app We will collect location information about the location of Hoppy vehicles, the routes taken by those vehicles and the rental status of those vehicles. We will not collect location data that you do not voluntarily provide, but you must agree to provide certain location data in order to use the service. We also collect and store the source IP address of your device which may disclose the location of your device at the time you use the app.

Collection of personal data from or via social media sites or use of your social media login

When you interact with a service provider page or account on a social media platform, such as Facebook, Twitter, Google+, Tumblr, LinkedIn, YouTube or Pinterest, we may collect the personal information you make available to us on that page or account. including your account ID or ‘ handle ‘. However, we will comply with the privacy policy of the associated social media platform and we will only collect and store such personal information that we are permitted to collect by those social media platforms. If you publish your social media profile on our Service, we may collect personal information that you make available as part of that profile.

Collection of information from other sources

We may also collect information about you that we may receive from other sources or from our offline interactions with you to, among other things, enable us to verify and update the information in our records and to better tailor the app for you. We may also collect personal information from credit reporting agencies to determine, for example, your creditworthiness, credit score and credit utilization, in accordance with applicable law.

Collecting personal and non-personal information through surveys and promotions

From time to time, we may offer you the opportunity to participate in sweepstakes or other promotions on our Service, which may be sponsored or conducted by a third party. If you participate, we will request certain personal information from you. Participation in these sweepstakes and promotions is completely voluntary, and you therefore have a choice as to whether or not you wish to disclose this personal information. The personal information requested generally includes contact information. If a third party sponsor is involved, be sure to review that party’s privacy policy.

Collection of personal data from third parties by means of the Tell-A-Friend function

We may from time to time conduct a referral service to introduce people you know to our apps and service. If you choose to use our Referral Service to tell someone about our apps and service or a discount on apps and service, we will ask you for your contact’s name and email address. We will automatically send your contact a one-time email inviting them to visit our app. We store this information for the purpose of sending this one-time email and tracking the success of our referral program. Your contact may contact us at support@behoppy.eu to request that we remove this information from our database.

Use of cookies and other tracking technologies

Like many websites and mobile applications, we use “cookies”, which are small text files stored on your computer or device when you visit certain online pages that record your preferences and actions. We may also use cookies to monitor traffic, improve the app and make it easier and/or relevant to your use.

Like many apps, we use cookies, web beacons and similar technologies to record your preferences, track your use of our apps and your exposure to our ads. If you delete your cookies or set your browser or device to reject these technologies, some features of the app may not work or may not work as designed.

We use both “Session” cookies and “persistent” cookies. We do not use Flash cookies, web storage, web beacons or other technology that tracks your browsing history across multiple apps.

We use cookies for the other purposes set out below:

  • • We use cookies to remind us who you are and to find your account information in our database when you visit a service, so that you don’t have to log in every time you visit. This helps us provide you with service tailored to your specific needs and interests. A cookie is created when you register for a service.

Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use the apps, compile reports on app activity, and provide other services related to app activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor or not. The apps do not use Google Analytics to collect information that identifies you personally. The information generated by Google Analytics is transmitted to and stored by Google and is subject to the Google Privacy Policy. We may partner with third party advertising companies to better serve ads. These third party advertisers may use cookies alone or in combination with web beacons or other tracking technologies to collect information about you when you use the apps. They may collect information about your online activities during your activity in various apps and other online services. They may use this information to provide you with interest-based advertising or other targeted content. These online advertising partners may access or use your name, address, email address, phone number or other personally identifiable information from us without your consent. They may additionally use permanent IDs to anonymously monitor your Internet usage in other apps. Although we restrict their further use of such information, with sufficient data from other sources, such third parties may be able to identify you personally.

Third-party advertising companies and other non-affiliated advertisers also display ads on our apps. As part of their service, they may place a separate cookie on your computer or smartphone or use other data collection and tracking technologies to collect information such as your IP address, browser type, the server to which your computer is connected, the area code and zip code associated with your server, and whether you responded to a particular ad.

We have no control over these third parties’ tracking technologies, how they may be used, or the information they may collect, and we are not responsible for the privacy policies or content of those third parties. We may add to or change the list of third party ad servers from time to time and we encourage you to check this section for changes. Many of the third party advertisers that place tracking tools on our apps are members of Programs that offer you additional choices regarding the collection and use of your information.

Please note that opting out of ad networks does not mean that you will not receive advertising while using our apps or on other apps, nor does it prevent the receipt of interest-based advertising from third parties that do not participate in these Programs. How do we use your data?

We use the information we obtain from you to help us personalize and continually improve your experience with the app. We may use your personal and non-personal information in the following ways:

  • To upload your content to our app when you request it
  • To allow you to update, edit and manage your content in our app

  • To communicate with you about your response to a blog post

  • To optimize or improve our products, services and activities
  • Update the app automatically on your device
  • To detect, investigate and prevent activities that may violate – our policies or are illegal

Using your location information

In particular, we use your location data to:

  • Tracking the use of the Hoppy vehicles
  • Personalization of content on our app, including providing reports, recommendations and feedback based on your preferences
  • Optimize or improve our products, services and operations
  • Detect, investigate and prevent activities that may violate our policies or be illegal

Combination of your personal data

We use information from any part of the app or elsewhere in our network for reports and analysis, all of which are owned and operated by Hoppy, and we may combine information, collected in different parts of the app, into a single customer record or analysis or report. We also use and/or combine information we collect off-line or receive from third parties to improve, expand and verify the accuracy of your customer records.

To whom do we provide your information?

Except as stated in this Privacy Policy, we do not disclose information about your personal information, which we collect, to companies that are not part of Hoppy or its parent, subsidiaries or related entities. Under no circumstances will we sell or rent your personal information as part of a customer list or similar transaction.

Business partners, sponsors and third parties

We may share your personal data from time to time with our sponsors and other business partners. You may withdraw your consent to the sharing of your personal data with business partners and third parties at any time by contacting our customer service department.

Third party agents

We have outside agents, subsidiaries, affiliates and partners who perform functions on our behalf, such as hosting, billing, push notifications, storage, bandwidth, content management tools, analytics, customer service, fraud protection, etc. These entities have access to the personal information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of that personal information. They may not use, sell, distribute or modify this data in any way other than to provide the requested services to the app.

Emergency situations

We may also use or disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with applicable law or to comply with legal process served on us or the app; (b) protect and defend our rights or property, the app or our users, and (c) act in emergency situations to protect the personal safety of us, our affiliates, agents or the app’s users or the public. This includes exchanging information with other companies and organizations for fraud protection purposes.

What steps are taken to keep personal data safe?
We are concerned about ensuring the security of your personal information. We ensure the secure transfer of your data from your device to our servers. Personal information collected by our app is stored in a secure operating environment that is not available to the public. Our security procedures mean that we may occasionally request proof of identity before disclosing your personal information to you. Please understand, however, that while we do our best to protect your personal information as soon as we receive it, no transfer of data over the internet or any other public network can be guaranteed to be secure by 100%.

How can we transfer your personal data?

Your information collected through the app may be stored and processed in Belgium or any other country where Hoppy, its customers, affiliates or service providers maintain facilities. Hoppy, its customers, affiliates or service providers may transfer information we collect about you, including personal information across borders and out of your country or jurisdiction to other countries or jurisdictions around the world. If you are located in another region with laws governing the collection and use of data that may differ from the laws of Belgium, the Laws in force will always apply. Please note that we may transfer information, including personal data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.

Hoppy will take reasonable steps to protect the privacy of your personal information. By registering for and using the app, you consent to the transfer of information to the US or any other country in which Hoppy, its clients, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

How long do we keep your data?

Upon termination or deactivation of your account, Hoppy, its clients, affiliates or its service providers may retain information (including your profile information) and user content for a commercially reasonable time for backup, archival and/or monitoring purposes. If you have any questions regarding termination or deactivation of your account, please contact us directly at support@behoppy.eu.

What happens if I link to or from another app?

This app may contain links to other apps operated by third parties. Please note that the practices described in this privacy policy for Hoppy do not apply to information collected through these other apps. We are not responsible for the actions and privacy policies of third parties and other apps.

Applicable law

This app is published in Belgium. We try to protect the personal information of all users of our app and we try to comply with local data protection and consumer rights laws to the extent that they may apply to the services, but our app is based and directed at European citizens and our policy is to comply with these corresponding laws. If you are unsure whether this Privacy Policy conflicts with applicable local privacy laws where you are located, you should not provide your personal information to Hoppy.

Allocation

We may sell certain assets associated with the app. As a result, you should be aware that in such an event we may transfer some or all of your information to a company that acquires all or part of our assets or to another company with which we have merged. In such circumstances, we should, to the extent possible, require the acquiring party to follow the practices described in this Privacy Policy, as they may be amended from time to time. Nevertheless, we cannot promise that any acquiring company or the merged entity will have the same privacy practices or treat your information as described in this Privacy Policy.

Changes to this policy

As our app continues to evolve, we may add new services and features to our app. In the event that these additions affect our privacy policy, this document will be updated appropriately. We will prominently post those changes so you will always know what information we collect, how we might use that information, and whether we will disclose it to anyone. However, we encourage you to read this Privacy Policy each time you use our app in case you missed our notice of privacy policy changes. If you wish to change the type of communication you receive from us, including opting out of promotional communications from us, you may do so at any time by updating the communication preferences specified in your account profile through the app. Please note that this may affect your ability to access certain products and services, and that we may continue to send non-promotional communications such as staff confirmations, surveys, and other information about your use of the Service.

If you refer others to us using our email functionality, please note that they may choose not to receive promotional emails from us in the future by following the opt-out instructions in the email invitation.

You also have choices to limit certain tracking mechanisms that collect information when you use the app. Many web browsers automatically accept cookies, but you can change the setting of your browser to refuse cookies if you prefer. If you choose to decline cookies, certain features of our app, including the app itself, may not work properly or remain accessible to you. Please note that although you opt out of online behavioral advertising and other targeted advertising served by participating companies through the app, you will still see other types of ads on the app, it may not be as relevant or targeted to your interests.

Accessing and correcting your information. If you have an account with Hoppy, you can view and modify your information by logging into your account and editing your profile. Please note that we may not be able to delete your personal data without also deleting your user account.

You are not permitted to examine the personal information of any other person or entity, and may need to provide us with personal information to verify your identity before accessing data containing information about you. We may not honor any request to modify or delete personal information if we believe that to do so would violate legal or regulatory requirements, or that the information is inaccurate.

European users

As described above, we may also outsource the processing of your information to, or otherwise share your information with, trusted service providers and trusted business partners in countries other than your country of residence, including the United States and Canada, in accordance with applicable law. Such third parties may be engaged, among other things, in providing services to you, processing transactions and/or providing support services. By providing us with your information, you acknowledge such transfer, storage or use.

If you are an EU data subject, when we transfer information about you to such non-EEA members of our group or to third party information processors, we will take appropriate steps to ensure that such companies adequately protect your information in accordance with this privacy policy. Collection of personal data from third parties by means of the Tell-A-Friend function

We may from time to time conduct a referral service to introduce people you know to our apps and service. If you choose to use our Referral Service to tell someone about our apps and service or a discount on apps and service, we will ask you for your contact’s name and email address. We will automatically send your contact a one-time email inviting them to visit our app. We store this information for the purpose of sending this one-time email and tracking the success of our referral program. Like many websites and mobile applications, we use “cookies”, which are small text files stored on your computer or device when you visit certain online pages that record your preferences and actions. We may also use cookies to monitor traffic, improve the app and make it easier and/or relevant to your use.

We use both “Session” cookies and “persistent” cookies. We do not use Flash cookies, web storage, web beacons or other technology that tracks your browsing history across multiple apps.

We may partner with third party advertising companies to better serve ads. How do we use your data?

  • Tracking the use of the Hoppy vehicles

Combination of your personal data

We use information from any part of the app or elsewhere in our network for reports and analysis, all of which are owned and operated by Hoppy, and we may combine information, collected in different parts of the app, into a single customer record or analysis or report. We also use and/or combine information we collect off-line or receive from third parties to improve, expand and verify the accuracy of your customer records.

To whom do we provide your information?

Except as stated in this Privacy Policy, we do not disclose information about your personal information, which we collect, to companies that are not part of Hoppy or its parent, subsidiaries or related entities. Under no circumstances will we sell or rent your personal information as part of a customer list or similar transaction.

Business partners, sponsors and third parties

We may share your personal data from time to time with our sponsors and other business partners. You may withdraw your consent to the sharing of your personal data with business partners and third parties at any time by contacting our customer service department.

Third party agents

We have outside agents, subsidiaries, affiliates and partners who perform functions on our behalf, such as hosting, billing, push notifications, storage, bandwidth, content management tools, analytics, customer service, fraud protection, etc. These entities have access to the personal information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of that personal information. They may not use, sell, distribute or modify this data in any way other than to provide the requested services to the app.

Emergency situations

We may also use or disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with applicable law or to comply with legal process served on us or the app; (b) protect and defend our rights or property, the app or our users, and (c) act in emergency situations to protect the personal safety of us, our affiliates, agents or the app’s users or the public. This includes exchanging information with other companies and organizations for fraud protection purposes.

What steps are taken to keep personal data safe?
We are concerned about ensuring the security of your personal information. We ensure the secure transfer of your data from your device to our servers. Personal information collected by our app is stored in a secure operating environment that is not available to the public. Our security procedures mean that we may occasionally request proof of identity before disclosing your personal information to you. Please understand, however, that while we do our best to protect your personal information as soon as we receive it, no transfer of data over the internet or any other public network can be guaranteed to be secure by 100%.

Our Legal Basis for Using your Information

Your information collected through the app may be stored and processed in Belgium or any other country where Hoppy, its customers, affiliates or service providers maintain facilities. Hoppy, its customers, affiliates or service providers may transfer information we collect about you, including personal information across borders and out of your country or jurisdiction to other countries or jurisdictions around the world. If you are located in another region with laws governing the collection and use of data that may differ from the laws of Belgium, the Laws in force will always apply. Please note that we may transfer information, including personal data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. However, where such transfers take place, we will rely on Standard Contractual Clauses as approved by the European Commission to transfer data from the EEA, Switzerland and/or Gibraltar to the United States and other countries outside of where you might live.

Hoppy will take reasonable steps to protect the privacy of your personal information. By registering for and using the app, you consent to the transfer of information to the US or any other country in which Hoppy, its clients, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

How long do we keep your data?

We may retain your information only for so long as is necessary for the purposes for which we process the information as set out in this Policy. Records can be held on a variety of media (physical or electronic) and formats.

Retention periods are determined based on the type of record, the nature of the record and activity and the legal or regulatory requirements that apply to those records. We will in the normal course of events keep client records for up to 5 years.

However, in certain circumstances, we may retain your Personal Data for a longer period of time, where retention for compliance with a legal obligation to which we are subject, or in order to protect your vital interests of another natural person.

In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

This app may contain links to other apps operated by third parties. Please note that the practices described in this privacy policy for Hoppy do not apply to information collected through these other apps. We are not responsible for the actions and privacy policies of third parties and other apps.

Applicable law

This app is published in Belgium. We try to protect the personal information of all users of our app and we try to comply with local data protection and consumer rights laws to the extent that they may apply to the services, but our app is based and directed at European citizens and our policy is to comply with these corresponding laws. If you are unsure whether this Privacy Policy conflicts with applicable local privacy laws where you are located, you should not provide your personal information to Hoppy.

Allocation

We may sell certain assets associated with the app. As a result, you should be aware that in such an event we may transfer some or all of your information to a company that acquires all or part of our assets or to another company with which we have merged. In such circumstances, we should, to the extent possible, require the acquiring party to follow the practices described in this Privacy Policy, as they may be amended from time to time. As our app continues to evolve, we may add new services and features to our app. In the event that these additions affect our privacy policy, this document will be updated appropriately. If you wish to change the type of communication you receive from us, including opting out of promotional communications from us, you may do so at any time by updating the communication preferences specified in your account profile through the app. Please note that this may affect your ability to access certain products and services, and that we may continue to send non-promotional communications such as staff confirmations, surveys, and other information about your use of the Service.

If you refer others to us using our email functionality, please note that they may choose not to receive promotional emails from us in the future by following the opt-out instructions in the email invitation.

You also have choices to limit certain tracking mechanisms that collect information when you use the app. Many web browsers automatically accept cookies, but you can change the setting of your browser to refuse cookies if you prefer. If you choose to decline cookies, certain features of our app, including the app itself, may not work properly or remain accessible to you. In addition, you may also render some web beacons unusable by refusing or deleting the associated cookies.

Please note that although you opt out of online behavioral advertising and other targeted advertising served by participating companies through the app, you will still see other types of ads on the app, it may not be as relevant or targeted to your interests.

Accessing and correcting your information. If you have an account with Hoppy, you can view and modify your information by logging into your account and editing your profile. Please note that we may not be able to delete your personal data without also deleting your user account.

You are not permitted to examine the personal information of any other person or entity, and may need to provide us with personal information to verify your identity before accessing data containing information about you. We may not honor any request to modify or delete personal information if we believe that to do so would violate legal or regulatory requirements, or that the information is inaccurate.

European users

As described above, we may also outsource the processing of your information to, or otherwise share your information with, trusted service providers and trusted business partners in countries other than your country of residence, including the United States and Canada, in accordance with applicable law. Such third parties may be engaged, among other things, in providing services to you, processing transactions and/or providing support services. By providing us with your information, you acknowledge such transfer, storage or use.

If you are an EU data subject, when we transfer information about you to such non-EEA members of our group or to third party information processors, we will take appropriate steps to ensure that such companies adequately protect your information in accordance with this privacy policy.
